Dad Proof Terms of Use

Effective October 3, 2026

The short version

1. Agreement

These terms are an agreement between you and Owen N. Cherry Sr. ("we", "us") about your use of the Dad Proof app and its online features ("the service"). By using the service you agree to these terms and to our Privacy Policy. If you don't agree, don't use the service.

You must be at least 18 years old and able to make a binding agreement.

2. Not legal advice

Dad Proof is a record-keeping tool. We aren't a law firm, and nothing in the app, its tips, guides, ledgers, calculators or PDFs is legal, financial or tax advice.

For advice about your situation, talk to a qualified lawyer where you live.

3. Your content

You own everything you put into the app ("your content"). You're responsible for it, including that:

We don't claim any ownership of your content. If you use agency sharing or backup, you give us permission to store and transmit the encrypted copies only as needed to provide those features.

4. Rules for using Dad Proof

You agree not to:

We may suspend or close accounts that break these rules, and we'll cooperate with lawful requests where someone may be at risk.

5. Agency sharing

You choose who to share with, what they see and for how long. The people you share with can view, print or save what you share while their access is active. Revoking access stops them opening the records again, but it can't undo copies they've already made. We aren't responsible for what recipients do with records you share.

6. Your data, backups and losing access

Your records are stored on your phone. If your phone is lost, broken or reset, or the app is deleted, your records may be lost unless you have a backup.

7. Paid features

Dad Proof is free to use today. If we add paid features later, they may need a paid subscription. Purchases are made through the Apple App Store or Google Play and follow their payment, renewal, cancellation and refund rules. Subscriptions renew automatically until you cancel in your App Store or Google Play account settings. Prices may change, and we'll tell you before a change affects you.

8. Other services

Some features rely on other companies, such as our hosting and database provider, the app stores and your email provider. Their own terms apply to their services. We aren't responsible for services we don't control, including your bank, or any court or agency system.

9. Changes and availability

We may update, change or stop parts of the service. We'll try to give notice before removing a feature that affects your records, and the app will keep working with the records on your phone. The online features may sometimes be unavailable for maintenance or reasons beyond our control.

10. Ending this agreement

You can stop using the service at any time, and delete your account in the app (Export → Share with an agency → Delete my account). We may end or suspend your access to the online features if you break these terms or if we have to for legal reasons. Sections 2, 3, 6, 11, 12, 13 and 14 continue after this agreement ends.

11. Disclaimer

The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We don't guarantee the service will be error-free or uninterrupted, or that reminders will always be delivered, since that depends on your phone's settings. Always keep your own note of important dates.

12. Limit of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for the outcome of any legal case, lost data, or lost profits. Our total liability for any claim about the service is limited to the greater of what you paid us in the 12 months before the claim, or US$50.

Some places don't allow these limits, so they may not all apply to you. Nothing in these terms limits rights you have under consumer protection law that can't be waived.

13. Responsibility for misuse

If you break these terms or the law while using the service, and that leads to a claim against us, you agree to cover our reasonable costs of that claim, to the extent the law allows.

14. Governing law and disputes

These terms are governed by the laws of the State of New York, except where your local consumer law says otherwise. Before starting a formal dispute, please contact us so we can try to resolve it. Disputes will be handled in the courts of Nassau County, New York, and either of us may use small-claims court where it applies.

15. App Store terms

If you downloaded the app from Apple's App Store:

If you downloaded the app from Google Play, Google Play's terms also apply to your download.

16. Changes to these terms

We may update these terms. We'll change the date at the top and, for important changes, tell you in the app before they take effect. If you keep using the service after that, the new terms apply.
